当代英语中常常出现一些古英语词汇的地方.尤其在合同、协议等文件中此类古英语词汇仍然常常看到. 其实,它们在翻译的时候，颇让人感到枯燥无味和无法理解。但是,我们既然学习法律英语,就必须对它们有熟练的掌握，并在以后合同、协议文件翻译中正规使用他。

 

一、hereby

 

英文释义：by means of, by reason of this

 

中文一次：特此，因此，兹

 

用法：常用语法律文件、合同、协议书等正式文件的开头语；在条款中需要强调时也可用

 

语法：一般置于主语后，紧邻主语

 

例如： we hereby certify to the best of our knowledge that the foregoing statement is true and correct. 特此声明，据我们所知，上述声明内容真实，争取无误。

 

二、 hereof

 

英文释义：of this

 

中文译词：关于此点；在本文件中

 

用法：在表示上文已提及的“本合同的、本文件的…”时，使用改词。

 

语法：一般置于要修饰的名词的后面，与之紧邻。

 

例如：本合同条件、条款 the terms, conditions and provisions hereof，这里的hereof表示“of this Contract;

 

本法规定：the provisions hereof，hereof表示 of this Law

 

本工程的任何部分，可用“any parts hereof”，这里的hereof表示“of this Works”。

 

违反本款规定：in default on the provisions hereof，这里的hereof表示of this Clause

 

本法第十五条、第十六条 Article 15 and Article 16 hereof。 Hereof：of this Law

五、hereinafter

 

英文释义：later in the same Contract

 

中文译词：一下，在下文

 

语法：一般与referred to as，called等词组连用，以避免重复，置于这些词组前面，与之紧邻。

 

例如：以下简称甲方：hereinafter referred to as Party A

 

以下简称外资银行分行：hereinafter referred to as foreign bank branches

 

以下简称外国股东：hereinafter referred to as foreign shareholders

 

六、herein

 

英文释义：in that；in that particular；in that respect

 

中文译词：在那里；在那点上，在那方面

 

用法：在表示上文已提及的“合同中的…，工程中的…”等时使用。

 

语法：置于所修饰词后，紧邻修饰词。

 

例如：修补工程中的缺陷：the remedying of any defects therein。此处的therein表示in the works

 

用于工程中的材料或机械设备：materials or plant for incorporation therein。这里的therein表示in the works

 

地方当局的税收当局：taxing authorities thereof or therein。Therein: in local authorities

 

因此所遭受的损失：any losses occurred therein。Therein：in the above-mentioned matters

 

七、thereof

中文译词：由此，其

 

用法：在表示已提及的“人或事的…”时，为避免重复，可使用该词。

 

语法：置于所修饰词后，紧邻修饰词。

 

例如：合同条件、条款：the terms, conditions and provisions thereof。此处的thereof表示of the Contract

 

      有关这方面的通知：the notice thereof。Thereof：of the above-mentioned matters

 

      税收的停征：the cessation thereof。Thereof：of tax

 

      仲裁申请书副本：the copies thereof。Thereof：of the application for arbitration

 

      工程任何部分、区段：any section or part thereof。Thereof：of the Works

八、thereafter, thereto, therewith, therefor, thereunder

 

1）Thereafter: after that 此后；之后

 

2）thereto：to that 随附；附之

 

3）therewith：with that 与之；与此

 

4）therefor：for that 因此；为此

 

5）thereunder：under that 在其下；依照

 

用法：本节提及的各词，其用法与上面七节谈及的一样，主要强调的是“that”。如果强调的是“this”，则要用thereafter，hereto，herewith和hereof等。

 

语法：紧接所修饰词之后。

 

例如：合同双方：the parties thereto。Thereto：to the Contract

 

及其改进发展的产品：together with all improvements and modifications thereof or developments with respect thereto。Thereof：of the Contract Products；thereto：to the Contract Products

用法：常用于合同协议书的开头段落中，以引出合同双方要订立合同的理由或依据。

 

语法：紧接于要修饰词之前，常位于句首。

 

例如：鉴于乙方有权并同意将专利技术的合同产品的试用权、制造权和销售权授予甲方：whereas Party B has the right and agrees to grant Party A the rights to use, manufacture and sell the Contract Products of Patented Technology
